  • Medical Aid Payments: The courts have repeatedly affirmed that medical scheme payouts do not relieve the RAF of its statutory liability to pay past medical expenses. Benefits received from your medical scheme are considered an independent arrangement (res inter alios acta).
  • Personal Accident Policies: Payouts under private personal accident policies or capital disability cover generally do not reduce your RAF claim for general damages or loss of earnings, as they represent the return on private insurance premiums paid by the policyholder.

If your medical scheme pays your hospital bills right after an accident, those payments usually follow the scheme’s rules for reimbursement.

Under Section 17(1) of the RAF Act, an injury is classified as serious through two distinct evaluation methods conducted by a registered medical practitioner on a RAF 4 Serious Injury Assessment Report:

  • 30% Whole Person Impairment (WPI): The injury results in 30% or more impairment according to the American Medical Association (AMA) Guides.
  • The Narrative Test: If the injury evaluates below 30% WPI, it may still qualify under the Narrative Test if it results in:
  • Serious long-term impairment or loss of a bodily function;
  • Permanent severe disfigurement;
  • Severe long-term mental or severe behavioural disturbance; or
  • Loss of a foetus.
