The Expert will be specific knowledgeable people at the Department of Transport, Arrive Alive Communications, the Road Traffic Management Corporation or others who might have the expertise to answer the question.
1. A Traffic Officer issuing a fine needs to have an appointment card from the relevant traffic authority in their possession when they issue a fine. This must have their infrastructure number on it and must be presented on request and they must be appointed as a peace officer or police officer. This is all they are required to have on them in order to issue a fine unless they were the operator of a speed measuring device and the fine is being issued for speeding.
2. Any Traffic Officer operating speed measuring equipment (SME) must be in possession of an operator certificate for the exact model of SME that is being operated and may not use that equipment for purposes of a speed measurement exercise (speed trap). This certificate must be presented for inspection if requested and must be at the trap site at the time of the exercise.
In both of these situations – not having the relevant documentation does not strictly allow them to issue a fine, however in practice it still happens and the courts will accept proof of existence of these after the fact, provided such documents were issued prior to the fine being issued.
