Road Traffic Legislation Update

The Minister of Transport has published the Road Traffic Management Corporation Regulations, 2022 in Government Gazette 45738, in notice NO. 1671 on 14 January 2022.

The gazette regulates the fees for RTMC services as well as convenience fees for the application and issue of certain documents in terms of the National Road Traffic Act, 1996.

AARTO:

•    The Pretoria High Court has declared the AARTO Act, 1998 and the Amendment to the Act in 2019 unconstitutional. In terms of the Constitution, a declaration from the High Court must be confirmed by the Constitutional Court.  

•    The Minister of Transport indicated on 18 January 2022 that the decision will be appealed.  

•    The RTIA issued a media statement on 19 January 2022 to indicate that AARTO continues until the Constitutional Court ruling has been finalised.

•    If the judgement from the High Court is confirmed, the court may provide interim measurements to regulate the matters that are affected by the decision such as outstanding infringement notices and enforcement orders.
